General Terms and Conditions for Holiday Rentals – Vale Vinagre

Welcome to Vale Vinagre. Below you will find the general terms and conditions applicable to the rental of our holiday villas with private pool in the Algarve. By making a booking, you agree to these terms.

1. Applicable Law All reservations and stays are exclusively governed by Portuguese law, in particular the Portuguese Civil Code (Código Civil Português) and Law No. 6/2024 (*Lei n.º 6/2024* – Local Accommodation).

2. Reservation and Payment A reservation becomes final upon receipt of the 30% deposit. The remaining amount must be paid no later than 60 days before arrival. For bookings made within 60 days of arrival, the total rental amount is due immediately.

3. Security Deposit (€500) Upon arrival, a security deposit of €500 is due. This deposit serves as security for damage, theft, excessive soiling, or violation of house rules. The deposit will be refunded within 14 days after departure, after deducting any repair costs or fines. If the damage exceeds the deposit, the additional amount will be recovered from the tenant.

5. Check-in and Check-out Check-in: from 4:00 PM. Check-out: no later than 9:30 AM. For late check-out: €50 per hour commenced (after 11:00 AM: full overnight stay). Late check-out (max. 2:00 PM) possible for €75, subject to availability.

6. Damage Inspection upon Arrival (within 2 hours) Within 2 hours after arrival, you must inspect the villa and the pool for visible damage. Any damage must be reported in writing and electronically to: info@valevinagre.eu (with clear photos). Damage not reported within 2 hours will be presumed to have occurred during your stay and will be deducted from the security deposit. Hidden defects can be reported during your stay.

7. Prohibitions 🚫 Pets: Not allowed. Violation: €250 fine + immediate termination of the rental agreement without refund. 🚫 Smoking: Not allowed inside the villa. Smoking in the villa: €200 fine + additional cleaning costs (min. €150). 🔊 Noise disturbance: Quiet hours between 10:00 PM and 7:00 AM (Portuguese law). Violation: €150 fine + risk of eviction.

8. Liability for Accidents The tenant is fully liable for all accidents, injuries, drowning, death, or damage occurring in and around the villa, the garden, and the private pool. This applies to all guests, children, and visitors. Children under 16 years of age are never allowed near the pool without supervision. Use of the pool under the influence of alcohol is prohibited. The landlord is not liable unless there is gross negligence (e.g., a knowingly unsafe installation). We recommend taking out travel and liability insurance.

9. Obligations upon Departure Leave the kitchen clean (dishes washed, empty refrigerator). Remove household waste (outside bins). Switch off air conditioning, heating, and all appliances. Close windows and doors. Return keys. Heavy soiling will incur additional cleaning costs (€75 – €150).

10. Access for Maintenance The gardener and pool maintenance personnel have the right to enter the property once or twice a week without prior notice. Refusal of access: €50 fine per occurrence.

11. Force Majeure and Landlord Liability The landlord is not liable for failure of water, electricity, internet, or pool pump due to supplier issues, storms, or force majeure. If the villa is unavailable due to an emergency, a replacement accommodation will be offered or paid amounts will be refunded (no further compensation).

12. Registration (SEF / RNAL) Under Portuguese law, we are obliged to register the identification details of all guests with SEF (Foreigners and Borders Service) before arrival. Without complete details, access may be refused.

13. Disputes All disputes shall be submitted to the court of Silves (Portugal).
